Title IX Resources
This guide provides an overview of the Title IX procedures at Norwich Free Academy (NFA). It references Board Policy, the roles of the Title IX Team, definitions of discrimination and harassment under Title IX, the supportive measures, complaint and grievance procedures, and the informal resolution opportunities.
Board Policies
Pursuant to Title IX’s 2024 Final Rule, Norwich Free Academy does not discriminate on the basis of sex and prohibits sex discrimination in any educational program or activity that it operates, as required by Title IX and its regulations, including in admission and employment.

Definitions
Sex Discrimination
When a person, because of the person’s sex, is denied participation in or the benefits of an educational program.
Sex Based Harassment
A form of sex discrimination and means sexual harassment and other harassment on the basis of sex, including on the bases of sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orienation, and gender identitty, that is: (1) quid pro quo harassment; (2) hostile environment harassmet; or (3) specific offenses as defined by federal statutes (sexual assault, dating violence, domestic violence, stalking)
Hostile Environment Harassment
Unwelcome sex-based conduct that, based on the totality of the circumstances, is subjectively and objectively offensive and is so severe or pervasive that it limits or denies a person’s ability to participate or benefit from the education program or activity (i.e., creates a hostile environment).
Pregnancy and Related Conditions
Pregnancy and related conditions means the following:

Pregnancy, childbirth, termination of pregnancy, or lactation;

Medical conditions related to pregnancy, childbirth, termination of pregnancy, or lactation; or
-
Recovery from pregnancy, childbirth, termination of pregnancy, lactation, or related medical conditions.
Pregnancy Notification Requirements
All Employees Must:

When notified by a student OR a student’s parent that the student is pregnant or has a related condition, promptly

Provide the student or parent with the Title IX Coordinator’s contact information; and

Inform the person that Title IX Coordinator can coordinate specific actions to prevent sex discrimination and ensure the student’s equal access to the educaton program or activity.

The Title IX Coordinator oversees all aspects of Title IX compliance, including the management of complaints and coordination of training programs.The Title IX Coordinator is responsible for receiving complaints or allegations of sex discrimination, including sex based harrassment.
Investigators are responsible for gathering facts and evidence, conducting unbiased examinations. The decision makers review the information collected by the investigator and make a determination.
The investigative process is a bifurcated model that clearly separates the roles of investigators and decision makers. Additionally, the Informal Resolution Facilitator offers a less formal pathway for resolving disputes, mediating cases outside of the formal investigation process. This separation of duties within the investigative and resolution process maintains the integrity and transparency of handling reports of Title IX complaints.
Filing a Complaint
A complaint is any oral or written request to the Title IX Coordinator that objectively can be understood as a request to investigate and make a determination about alleged discrimination under Title IX. A complainant can be a student or an employee. When an oral or written complaint of sex discrimination is filed, the Title IX Coordinator assess it, and informs the complainant of their rights, and outlines the grievance procedures. The Title IX Coordinator will also offer supportive measures as appropriate for the complainant. NFA will treat the complainant and respondent equally and will facilitate Title IX complaints through a structured, equitable process.
Grievance Procedure
Grievance Procedure Process
When the Title IX Coordinator receives a notice that may indicate sex discrimination, they will intiate the grievance procedure by offering supportive measures to the complainant, regardless of whether a formal complaint is filed.

Supportive Measures
The Title IX Coordinator will offer supportive measures as appropriate for the complainant. NFA will treat the complainant and respondent equally and will facilitate Title IX complaints through a structured, equitable process. If the complainant refuses supportive measures or if these measures prove to be ineffective, the filing of a formal complaint, signed by the complainant and the Title IX Coordinator is the first step of the formal grievance procedure. The Title IX Coordinator will notify both the complainant or the individual who reported the conduct, as well as the respondent, of the grievance procedures and the informal resolution process. Additionally, both parties will be reminded that retaliation in any form is prohibited.
Formal Complaint Signed
The filing of a complaint that is signed by the complainant and the Title IX Coordinator is the first step of the formal grievance procedure. The Title IX Coordinator will communicate the grievance procedure steps to the complainant and respondent. The process must treat complaints and respond equally. The Title IX Team will initiate the grievance procedure below:
Informal Resolution Process
The informal resolution process provides both parties with an opportunity to engage in direct dialogue to understand each other’s perspectives through mediated discussions when appropriate and agreed upon, involving allegations that may fall under Title IX discrimination. The objective is to reach a mutually agreeable settlement without proceeding to more formal grievance steps. However, should any party choose to withdraw from the informal process at any time, they retain the right to resume the formal grievance procedures.
The role of the Informal Resolution Facilitator is crucial in this process, and is distinct from the investigator or decision maker of the case, ensuring an unbiased, impartial facilitation of discussions between the involved parties.
Investigation
NFA has adopted a Bifurcated Investigation Model to separate the role of the investigator and decision maker. The process involves interviews with all parties involved, including witnesses. Both parties, the complainant and respondent will be given equal opportunities to respond to the evidence collected.
Decision Maker and Appeal Process
The Title IX Decision Maker Determination process is a comprehensive and structured approach to handling complaints of sex discrimination, including sex-based harassment. The decision maker evaluates credibility based on witness information, corroborative evidence, and motives to falsify. Using the preponderance of evidence standard (more than not responsible , more likely true than untrue), the decision maker determines whether discrimination occurred. Based on this evaluation, the decision maker either substantiated or unsubstantiated the accusation The final decision is communicated in writing to all parties, providing rationale and outlining appeal procedures.
